Probating the Estate of a Loved One

My clients come to see me because they have recently suffered the loss of a loved one, and are facing the complicated process of probating the estate. Probate is the legal process for proving the estate after death. The probate court will determine if a valid will exists and then appoint an administrator.

I assist the administrator of the estate, usually a friend or family member of the deceased to help fulfill their duties during probate, including filing the necessary paperwork. It is not uncommon for will contests to occur if there are disagreements between the heirs of the estate for various reasons.

The probate court also performs several functions outside of probating the estate. I can help clients work with the probate court to establish guardianships or conservatorships when their loved ones are no longer in a position to care for themselves of their finances. The probate court also handles mental commitments for someone that is mentally ill and is a danger to others.

Compassionate Approach to Client Consultation

When I meet with clients, I ask them to bring in all the relevant documents, including the will, to gain an understanding of what types of services that may be required. I explain the probate process to my clients including what will happen and how long the process typically takes from start to finish. Depending on the circumstances, probate can be a long process and my clients can be assured that they are working with an experienced probate lawyer.
